SO, IS IT LEGAL?

When the Assault Weapons Ban was in place, it would have been illegal to add a feature like a folding stock to your rifle. Nowadays, it is perfectly legal. As always, however, check your state and local laws. It all has to do with the interpretation of how to measure the length of the rifle, without a folding stock and with a folding stock. That being said, it is legal to own a rifle with a folding stock, just don't turn it into an SBR. Standard lawful measurements still apply. ATF has rescinded the prior methods of measurement of a firearm's overall length when the firearm is equipped with a "stabilizing brace". ATF Guidance for folding stocks is that "stabilizing braces" are merely accessories and are not relevant to the classification of a 'pistol' under the statutory definition. That is, a folding stock on a rifle or shotgun is included in overall length measurements because the firearm must be 'designed or redesigned-.and intended to be fired from the shoulder' to be so classified. The stock is therefore an essential element in the statutory definition. I accented the above portion of content because of 2 key parts; shoulder, and essential element. A stock or "stabilizing brace" is an essential component when firing a firearm from the shoulder. A shoulder-fired firearm is what separates a rifle with a folding stock from a pistol. Overall measurements with the folding stock still apply to standard rifle measurements; a rifle barrel should not be less than 16", with an overall length of 26".
